In a recent update we learnt that the European Commission (Cion) is expected to release the final version of the MCC by late January / early February 2012. They have had to reopen the Code to amend the implementation date from June 2013 to, probably 2016 and have seen this as an opportunity to address two other key matters.
First, the discussions on the MCC Implementing Provisions (MCCIPs) and Business Process Model (BPMs) had identified items within the MCC which needed to be changed. Additionally changes are required because the new legal base of the MCCIP has to be compliant with the Lisbon Treaty. There are said to be about 40-50 areas which had to be changed in the MCC to make it Lisbon compliant. Lisbon would break the MCC into delegated powers and implementing powers. Lisbon creates two types of empowerment, delegated and implementing.
We understand there are still concerns (particularly in the UK) about proposed changes to valuation, level 2 transit procedures, guarantees, temporary storage and centralised clearance and it will be interesting to see how these areas will be reflected in the final version of the MCC.
